Courts Upholds $28 Million Award in Grand Canyon Skywalk Case

A federal court dealt a blow to the business arm of a northern Arizona tribe that owns the Grand Canyon Skywalk by upholding a $28.5 million judgment in favor of a Las Vegas developer who invested the money to build the horseshoe-shaped glass bridge on tribal land.

The ruling by U.S. District Judge David Campbell rejected arguments by the Hualapai Tribe that the award isn’t enforceable, calling one of the arguments “nonsensical” and another “odd.” The American Arbitration Association had determined David Jin is owed the money, mostly for management fees that he was to receive under a 2003 contract with the tribe.

Mark Tratos, an attorney for Jin, said Monday the ruling shows U.S. citizens have recourse in contract disputes with American Indian tribes.

Court Invalidates Sex Harassment Award to Southern Mississippi Coaches

The Mississippi Supreme Court has ruled against three former University of Southern Mississippi soccer coaches who claimed sexual harassment and sexual discrimination.

The Hattiesburg American reported that the ruling reversed a 2008 Forrest County Circuit verdict that awarded a total of $1.2 million in damages to the coaches.

The Supreme Court found insufficient evidence to the jury’s verdicts in favor of former head coach John Vincent and assistant coaches John Mollaghan and Ged O’Connor, who claimed sexual harassment, gender discrimination and retaliation at the hands of Southern Miss employees.

Vincent, Mollaghan and O’Connor filed suit in 2000, naming as defendants former Southern Miss athletic director Richard Giannini, senior women’s administrator Sonya Varnell, former Southern Miss President Horace Fleming and the university.

Paul Graham Wins $150K Hasselblad Award

British photographer Paul Graham has won the 2012 Hasselblad Foundation International Award in Photography, the foundation has announced. The award includes a $150,000 prize and an exhibition, which will open October 26 at the Gothenburg Museum of Art in Sweden.

In announcing the award, the foundation recognized Graham as “one of the most brilliant photographers of his generation” who has presented “an extremely focused body of work, at once perfectly coherent and never monotonous” during a career that has spanned nearly 40 years. The foundation also praised Graham for work that “makes tangible the insignificant traces of ‘the spirit of the times’ we do not normally see,” and it credited the photographer with developing “innovative forms of working with all aspects of photography.”

Graham has produced several noteworthy bodies of work, most recently his 2009 12-volume book titled A Shimmer of Possibility. Previous works include American Night (2003) and Beyond Caring (1985).

Graham explained to the Guardian in an interview last year, “”It has steadily become less important to me that the photographs are about something in the most obvious way. I am interested in more elusive and nebulous subject matter. The photography I most respect pulls something out of the ether of nothingness.”
